Twitter is trying to find paperwork associated to the SEC investigation into Elon Musk

Twitter said in a court filing released Thursday that it was trying to obtain documents from Elon Musk related to a federal investigation Tesla The CEO’s $44 billion bid for the company.

Lawyers representing Twitter said the company first requested the materials related to the investigation on July 22, and that Musk’s legal team failed to comply, citing “investigative privilege,” according to the filing.

“Elon Musk is currently under federal investigation for his conduct in connection with the Twitter acquisition,” the attorneys wrote. “Through a lawyer, he exchanged essential correspondence with these authorities regarding their investigations.”

Twitter’s attorneys said the documents “address key issues in this litigation.”

Musk initially agreed to buy Twitter in April before then attempting to go out of business, claiming the company had not been transparent about the number of bots and fake accounts on the platform. Twitter sued Musk in July to force him to close the deal. The two sides were due to stand trial in Delaware Chancery Court on Oct. 17, but Musk reversed course again last week, saying he would buy Twitter at the agreed price of $54.20 per share.

A court judge ruled Thursday that Musk has until October 28 to complete the acquisition if he wants to avoid a lawsuit.

Meanwhile, Twitter is still tracking information. The latest filing relates to a letter the Securities and Exchange Commission sent to Musk in June. The SEC was seeking information related to a tweet by Musk published in May indicating that the “deal cannot go ahead” until the company provides it with more information about spam and fraud accounts on the platform.

Twitter’s attorneys said the creation of the documents “would not present any real burden as it is a discrete collection of readily identifiable materials in the attorneys’ files that they wrote, reviewed or received.”

“This hide-and-seek game must end,” the lawyers wrote.
