Democrats reintroduce PRO labor rights regulation amid Covid pandemic

The Democrats on Thursday reintroduced a comprehensive labor rights bill, touted as a means of creating safe jobs and increasing worker benefits during the coronavirus pandemic.

The party tabled the PRO law, a measure to promote trade union organization that was approved by Parliament last year. The legislation would:

  • Allow the National Labor Relations Board to impose fines on employers who violate workers’ rights
  • Give employees more power to take part in strikes
  • Weaken the so-called labor law
  • Offer employee protection to certain independent contractors

Republican lawmakers and the Chamber of Commerce have argued that the plan would hamper the economy, making it doubtful that Democrats will win the 10 GOP votes needed to get them through the Senate. Even so, the bill underscores the Democrats’ drive to strengthen unions after years of eroding membership.

House Committee on Education and Labor Chairman Bobby Scott, D-Va., Said the bill would help key workers secure higher wages and paid vacation if the virus spreads.

“The COVID-19 pandemic has shown that Congress urgently needs to protect and strengthen workers’ rights,” he said in a statement on Thursday. “Last year workers across the country were forced to work in unsafe conditions because they were not paid enough, because they were unable to stand together and negotiate with their employer.”

The reintroduction of the law underscores the party’s renewed focus on unified control of Congress and the White House to strengthen labor rights. President Joe Biden, who said during his campaign that “unions built the middle class”, took early steps to promote workers’ right to organize.

On his first day in office, Biden fired Peter Robb, General Counsel of the National Labor Relations Board, whose actions union leaders had criticized. He also elected a union leader in the Boston Mayor, Marty Walsh, as his labor secretary.

The Senate Committee on Health, Education, Labor and Pensions held the Walsh confirmation hearing Thursday morning. During her inauguration of Walsh, committee chairwoman Senator Patty Murray of Washington extolled the PRO Act as one of the guidelines she wanted to pursue.

The PRO Act would enable the NLRB to impose penalties on companies or even company leaders who violate labor laws. The bill also requires the NLRB to reinstate workers while their complaint against an employer is heard.

If passed, the bill would limit the power of Republican-backed laws across the country that prevent workers from joining a union or paying dues as a condition of employment. Attempts are also being made to reduce the use of independent contractor classification by companies like Uber. The question of whether so-called gig workers should be classified as employees has become a point of contention in California.

When the Democrats passed the law in 2019, Chamber of Commerce executive director Glenn Spencer called it “bad for workers, employers and the economy”.

Republican leaders targeted unions in the early days of the Biden administration. Teachers, one of the most heavily unionized professions, have refused to return to teaching in person in some cities because of concerns about contracting the virus.

On Wednesday, the head of the Centers for Disease Control and Prevention announced that schools can safely reopen even if teachers do not receive the Covid vaccine. Senate Minority Chairman Mitch McConnell, R-Ky., On Wednesday criticized what he called “the whims of powerful public sector unions” as he urged students to return to school.

NFL makes Covid security plans for followers

The National Football League is preparing for the final competition of the season with Super Bowl LV in Tampa Bay, and the league promises the event will not become a Covid-19 superspreader.

The NFL said it would be handing out kits of hand sanitizer and KN95 masks to fans during Sunday’s game between the Kansas City Chiefs and Tampa Bay Buccaneers to limit the spread.

NFL manager Jeff Miller said the wearing of masks will be mandatory for fans, players and team staff and the league will enforce social distancing measures. The NFL said attendance at the 65,000-seat Raymond James Stadium will be limited to 25,000, including 7,500 vaccinated health workers.

“It has been a lot of work by a lot of people and a lot of commitment with local, state, and national health officials to do this as safely as possible,” said Miller, who oversees the NFL public and political affairs.

Health and safety experts speaking to CNBC agreed with the way the NFL is coordinating their event, but still raised issues.

“My biggest concern about when Covid-19 could spread in the stadium isn’t necessarily with people sitting in their seats,” said Stephen Kissler, an epidemiologist at Harvard University. “It is actually when they mingle in other parts of the stadium.”

What is the plan?

Kissler, a researcher in the Department of Immunology and Infectious Diseases, said people who gather in lines to enter the stadium or wait for concessions are more likely to spread droplets containing the virus.

To counteract this, the NFL has its own entry points, which are larger for the fans present, although they don’t offer temperature tests at the gates.

The NFL also sells Super Bowl tickets in groups of two to six so that they can sit in “pods” together. Jonathan Barker, the NFL’s head of live event production, said the pods were not placed too close together and a maximum of 10 people per pod.

“There will never be anyone in front of or behind another person,” said Barker, counting on 30,000 clippings of fans to fill the empty spaces.

Barker, who has been in Tampa Bay since Jan. 4, said the stadium had undergone rigorous daily cleaning. “And when we have three days off, we will step up that effort to clean, disinfect and disinfect everything,” he said.

The NFL estimates that by kick-off there will be around 200,000 health screenings for people working on the event, including staff. BioReference Laboratories, a diagnostics company, supports the NFL’s health and safety efforts at Super Bowl LV. The company is expected to distribute 35,000 PCR tests to employees and salespeople at the stadium.

In order to limit contact, the NFL has partnered with Visa to offer cashless ATM transactions. These corporations will go in two different directions.

In Tampa Bay, Mayor Jane Castor mandated outdoor masks near targets near the Super Bowl. Epidemiologist Kissler said the limited capacity and atmosphere outdoors, as well as the vaccinated fans should help, but warned, “We still don’t know exactly how much the vaccine prevents the spread of Covid-19.”

“We have to remain vigilant, keep our distance, wear masks and keep up with sensible measures that we have become so familiar with over the course of the year,” said Kissler.

Dr. Allen Sills, the NFL’s chief medical officer, said the tracing plans were shared with federal health officials, including President Joe Biden’s Covid Task Force. He said the “detailed plan” provided guidelines for getting on and off.

“We take our responsibility very seriously to model the best behavior and show how we believe an event of this magnitude can be safely conducted,” said Sills.

No signs of anger

Although the league had its own problems with outbreaks among players and staff during the regular season, Sills said no persistent cases had occurred over NFL games. Miller said over 1 million people played 116 NFL games during his pandemic season.

“We haven’t traced an outbreak or cluster of cases to any of the places we’ve hosted fans,” said Sills. “It’s an important benchmark for us and something we’re really focusing on in this game.”

The league released the latest Covid test results on Tuesday, reporting zero new positive results from the players and one from the staff. To date, the NFL said 262 players and 463 staff have tested positive.

It is unknown if the NFL is insured for the Super Bowl. While discussing the NBA bubble in July, Attorney Alan Taylor suggested that the leagues need to seek new event guidelines as most had no insurance for a pandemic. Until the federal government supports such measures, they are likely to remain expensive.

“The guidelines that the professional leagues must receive must be new guidelines based on the new situation we are in,” said Taylor, co-chair of the professional liability division of Segal McCambridge Singer & Mahoney law firm.

Gil Fried, a stadium safety and risk management expert at the University of New Haven, said the NFL has a safe way out of legal troubles when outbreaks occur.

Fans participating in the game consent to the “taking of risks” associated with attending such an event, with Covid still very active. According to the Buccaneers website, fans must “leave, and not enter, the stadium grounds” if they do not consent to the risks associated with visiting Raymond James Stadium.

“This is a very big shield that the NFL will have,” Fried said. “I think the NFL will do a good job of enforcing the rules, but I think it’s a bigger problem with the fans and what they do,” he added. “You can have any rules you want, but if the fans don’t follow or do what they’re supposed to, you’re going to get into serious trouble.”

Fried suggested that the NFL use frequent announcements and other behavioral triggers to help fans adhere to protocols.

“They need signs,” said Fried. “They need announcements on their tapes in the stadium that all say, ‘This is what you have to do.’ They need to be constantly reminded. And make sure your security enforces it and dump them if they don’t meet the requirements. “

Victoria’s secret guardian L Manufacturers raises forecast, says CFO is retiring

Victoria’s secret parent company L Brands shares rebounded Thursday after raising their quarterly outlook. They said they had strong sales in January and reiterated their plans to separate their businesses.

It also announced long-time CFO Stuart Burgdoerfer’s plans to retire in August. A search for his replacement is ongoing.

Burgdoerfer served as interim CEO of the lingerie retailer and will be replaced immediately in this role by Martin Waters, who is currently CEO of Victoria’s Secret Lingerie.

The company raised its earnings guidance for the fourth quarter from $ 2.70 to $ 2.80 per share to $ 2.95 to $ 3.00 per share. Sales in the same store are expected to increase 10% in the quarter, which includes a 22% increase at Bath & Body Works and a 3% decrease at Victoria’s Secret.

Shares rose more than 9% on Thursday morning. They are up 85% over the past year, bringing the company’s market value to $ 13.36 billion.

L Brands plans to separate its two brands, Victoria’s Secret and the faster growing Bath & Body Works, by August.

Kenneth Frazier of Merck will retire as CEO efficient June 30th

The outspoken chairman and CEO of Merck, Ken Frazier, is retiring after almost 30 years with the drug manufacturer, the company announced on Thursday.

The 66-year-old Frazier will be replaced by Chief Financial Officer Robert Davis as CEO on June 30 and will continue to serve as Chairman of the Board of Management of Merck, “for a transition period to be determined by the Board of Directors,” the company said. Frazier, one of the few black corporate executives in the United States, has been CEO of Merck since January 2011.

“It has been a privilege to serve as CEO of Merck for the past decade and to work with the most dedicated and talented employees and management team in the industry,” Frazier said in the statement. “As CEO, I look forward to working with Rob and our Board of Directors to help Merck be even more successful.”

Frazier’s final years at Merck were marked by his outspoken opposition to former President Donald Trump. He led a revolt among CEOs when he first stepped down from Trump’s American Manufacturing Council shortly after the former president’s supportive comments on white nationalist and neo-Nazi groups at the deadly protest in Charlottesville, Virginia in 2017.

He urged business leaders to be a “unifying force” that can help resolve many of America’s racial inequalities by creating new opportunities and jobs. He said that education, and especially financial literacy, is the “great balance”.

After becoming a lawyer, Frazier rose to become one of the most famous black CEOs in the country. Before joining Merck, Frazier helped free a black death row inmate who was falsely accused of murder.

Davis will become President of Merck effective April 1, the company said. He joined the New Jersey-based pharmaceutical company in 2014 as the chief financial officer.

Two years later, Davis’ job was expanded to include “the company’s global support functions that include corporate development, investor relations, information technology, procurement, real estate, and corporate strategy.”

“Rob has been instrumental in helping Merck take the right steps to adapt to the changing healthcare environment, while continuing to invest in the scientific innovations that we expect will drive our future growth,” said Frazier.

Last week, Merck announced it would end development of two Covid-19 vaccines to focus on treatments, citing poorer immune responses in people who had recovered from the disease as well as those who reported for other vaccines were.

The company, which entered the vaccine race later than its competitors, expects initial efficacy data for an experimental oral antiviral, expected in late March.

Yum Manufacturers (YUM) This fall 2020 Earnings High Estimates

Yum Brands reported quarterly results and sales on Thursday that beat analysts’ projections, despite international dining room closures weighing on sales growth at KFC and Pizza Hut in the same business.

The company’s shares rose less than 1% in premarket trading.

The company reported, versus Wall Street’s expectations based on an analyst survey by Refinitiv:

  • Earnings per share: $ 1.15, adjusted versus expected $ 1.01
  • Revenue: $ 1.74 billion versus $ 1.72 billion expected

Yum reported net income of $ 332 million, or $ 1.08 per share, for the fourth quarter, compared with $ 488 million or $ 1.58 per share a year earlier.

Disregarding items, the company earned $ 1.15 per share, beating the analysts surveyed by Refinitiv at $ 1.01 per share.

Net sales increased 3% to $ 1.74 billion, beating expectations of $ 1.72 billion. Globally, the company’s sales in the same store declined 1% in the quarter, and Taco Bell was the only brand to see positive sales growth in the same store.

At KFC, total sales in the same store decreased 2%. Sales in the US in the same store increased 8%, in international locations sales in restaurants that have been open for at least a year decreased 4%. Only 18% of KFC’s sales come from its home market, and China accounts for more of its system sales than the US

Pizza Hut sales in the same store were only 1% lower for the quarter. The coronavirus pandemic has accelerated the U.S. turnaround and helped cement its reputation for delivery and takeaway rather than dining out. Pizza chain sales in the same store in the United States rose 8% for the quarter. Outside the US, however, Pizza Hut is taking longer to recover, and international sales in the same store were down 7%.

Habit Burger Grill, which was acquired by Yum last year, posted a 5% drop in sales in the same store. The burger chain is much smaller than the other brands from Yum.

Yum added 227 new Netto restaurants in the quarter. Pizza Hut was the company’s only brand to close more locations than opened.

Dubai rejects the Covid label “Superspreader” as a result of the restrictions are tightened

DUBAI, United Arab Emirates – Dubai has taken tough new measures to contain the spread of Covid-19 and is defending its strategy to fight pandemics after a surge in cases.

The record-breaking infection rates in recent weeks have forced Dubai to introduce new capacity cuts and a curfew on some businesses after opening up to tourists. The authorities blamed “a significant increase in violations of precautionary measures” for the new rules.

Last week the UK suspended all flights to the UAE – the busiest international route in the world. Meanwhile, Dubai banned its popular brunches and closed pubs and bars on Wednesday.

“The approach in the United Arab Emirates, and Dubai in particular, has always been backed by science, and science has informed common sense,” Dubai Health Authority deputy director Alawi Alsheikh-Ali told CNBC’s Hadley Gamble on Thursday.

“The numbers have increased but the health system has managed to keep up with the numbers and care for the sick and in response there have now been more restrictions on activities in the emirate and the UAE,” he added .

But as images of bustling beaches and Instagram celebrities on social media generate anger and envy in the international press, some are questioning the wisdom of Dubai’s strategy.

“What happened in Dubai didn’t have to happen,” Erin Bromage, a professor of biology at the University of Massachusetts at Dartmouth, who specializes in infections and immunology, told CNBC.

“They introduced the virus, including the new variants, in waves of new tourists and allowed it to spread to the community as well as uninfected tourists,” said Bromage. “The tourists are returning home and sowing infections there, possibly with the new variants.”

Travel hotspot

Figures from the UK Civil Aviation Authority show that almost 300,000 people traveled between the UK and the United Arab Emirates in November and December last year alone. Thousands are flocking to Dubai’s hotspots to escape lockdowns.

In the critical month of December – when a new and highly transmissible variant of the virus spread across the UK – 211,115 people traveled between the UK and the United Arab Emirates. The data only shows traffic to and from the UK and not other countries, which means the total number of travelers is likely to be much higher. Passengers had to be tested before boarding or on arrival.

“We have been following the numbers very closely and are very concerned about the increase in numbers and the emergence of new variants about two months ago,” said Alsheikh-Ali.

Cases have tripled since November, but UAE authorities deny the community is at risk and reject the idea that the city has become a hotspot for spreading the virus overseas.

“We saw variants … that have now been reported in more than 70 different countries,” said Alsheikh-Ali. “I don’t think identifying a particular country as a particular source for a particular variant is helpful,” he added.

Dubai’s business community, which has benefited from the open door policy, is also pushing back.

“Infection rates are much higher in the UK than they are currently in the United Arab Emirates, so it is clearly not the case that the United Arab Emirates are causing problems or being a super-spreader country,” said Chris Payne, Chief Economist, Dubai Peninsula Real Estate. said CNBC.

“The UAE have taken a different path, Dubai in particular, and I don’t blame them for that,” added Payne. “They believe that Dubai’s economy needs to be opened up and it has not been able to withstand the lengthy closures that we have seen elsewhere in the world.”

According to official figures from Johns Hopkins University, 3,310 new coronavirus cases were registered in the UAE on Wednesday, up from 2,730 on Tuesday. The average number of cases in the UAE over seven days is 3,500.

Distribution abroad

While the debate over Dubai’s virus strategy rages, at least two countries have raised concerns about passenger flows in the past few weeks.

Danish Transport Minister Benny Engelbrecht said at least “one citizen” had “brought back” the South African variant of the virus “from Dubai. Denmark has temporarily banned flights from the UAE due to criticism of test facilities in the Emirates.

The UAE has one of the highest per capita testing rates in the world, with a total of more than 26 million tests. According to the authorities, the test centers work according to international standards and are regularly checked.

Also of concern is Israel, where more than 900 travelers returning from Dubai have been infected with coronavirus. This comes from an Associated Press report quoting the Israeli military. It was said that returnees had “created a chain of infection with more than 4,000 people”.

CNBC was unable to independently review the report and has asked the Israeli military for comment.

Despite the allegations, the UAE authorities insist that they take effective measures to protect the safety of those living and visiting the UAE. That includes the frontline health workers dealing with the rising cases.

“It’s not a good idea, but life has to go on,” a medical worker who performed PCR testing in the finance sector told CNBC when asked if Dubai should remain open to travelers. “We just have to be responsible and watch out. I took my vaccine,” said the worker, who preferred to remain anonymous as he was not confident about speaking publicly without employer approval.

Authorities also turned down proposals for a shortage of hospital beds in Dubai.

“The healthcare system here in Dubai has managed to be ahead of the curve with the surge capacity. Any patient who needs a hospital bed can get it in Dubai today,” said Alsheikh-Ali.

Vaccination progress

The UAE is at the forefront of a global vaccination campaign. More than 2.7 million doses have already been administered with the Chinese shocks Sinopharm and BioNTech-Pfizer, and half of the 10 million residents are expected to be immunized in the first quarter.

“We currently have three different vaccines available for people in Dubai, with more than 120 vaccine access points, including home vaccinations for the elderly who fail to make it to the vaccination centers,” Alsheikh-Ali said when asked how authorities the vaccines wanted to alleviate last round of restrictions.

“Vaccinations are our exit strategy.”

JPMorgan takes a constructive view of Indonesia regardless of the rising Covid instances within the nation

SINGAPORE – JPMorgan sees the outlook for Indonesia as positive, although the country is still grappling with rising Covid infections and the number of cases has topped a million lately.

The country’s young population is part of the reason for this optimism, said James Sullivan, head of ex-Japan Asian equity research at the investment bank.

“Demographically, Southeast Asia is very different from some of the developed countries we compare these countries with,” Sullivan told CNBC’s Squawk Box Asia on Wednesday.

In 2015, the average age of the Indonesian population was 28.5 years, according to Statista.

“Because they’re so much younger, they tend to tackle the mortality side of this conversation significantly better than some of the older, developed economies,” he said. “That’s a very important distinction when we think about it.”

As a result, lockdowns “may not be as necessary” in such countries – compared to places with significantly older populations that are at higher risk from Covid-19, the analyst said.

India as an example

To make his point clear, Sullivan used the example of India, a country that, according to Johns Hopkins University, ranks second in the world after the United States in terms of the number of Covid infections.

“There was long talk of infection rates in India until around August last year,” he said, adding that there were “very dire predictions” about the impact of the pandemic on the Indian economy.

These fears regarding India do not appear to have materialized as the daily number of Covid cases in the country has decreased significantly since then. Analysts have also said the economic recovery has been stronger than expected.

Still, according to Hopkins, Indonesia has had the highest number of Covid-19 cases in Southeast Asia.

As of Wednesday, Indonesia had more than 1.11 million coronavirus infections while at least 30,770 people had died from Covid-19, information from the country’s health ministry showed.

Other factors

In addition to Indonesia’s relatively young population, JPMorgan also sees “positive efforts” to stimulate growth across Indonesia’s economy, Sullivan said.

The government is pushing for a mutual fund called the Indonesia Investment Authority. According to reports, Indonesian President Joko Widodo plans to raise up to $ 100 billion.

Sullivan added that there has been a “significant recovery” in manufacturing, particularly in the export sector. In addition, the JPMorgan analyst cited the government’s vaccine efforts as another reason for its positive outlook.

Indonesia launched a Covid-19 vaccination program in January, which Reuters has named as one of the world’s largest campaigns. The country’s finance minister, Sri Mulyani Indrawati, recently told CNBC that it will take Indonesia at least a year to achieve “herd immunity” – which is when a large section of the population becomes immune to the disease.
